Deuteronomy 17:5ExegesisTAB

Deuteronomy 17 : 5 Judgment | Accountability | Equality
5. Linguistic Exegesis
The verse opens with vehotseta {וְהוֹצֵאתָ | wə-hō-ṣê-ṯāʾ} ‘and you shall bring out,’ a causative Hiphil perfect with vav consecutive marking a judicial command. The phrase et-ha’ish ha-hu o et-ha’ishah ha-hi {אֶת־הָאִישׁ הַהוּא וְאֶת־הָאִשָּׁה הַהִוא | ʾet-hā-ʾîš ha-hû ū-ʾet-hā-ʾiššāh ha-hîʾ} ‘that man or that woman’ uses paired repetition for gender inclusivity. The relative clause asher asu et-hadavar hara hazeh {אֲשֶׁר עָשׂוּ אֶת־הַדָּבָר הָרָע הַזֶּה | ʾă-šer ʿā-sû ʾet-had-dā-ḇār hā-rāʿ ha-z-zeh} ‘who have done this evil matter’ tightly binds the offense to the judicial process. The specification el-she’arekha {אֶל־שְׁעָרֶיךָ | ʾel-šə-ʿā-rê-kha} ‘to your gates’ designates the communal venue for enforcement. Finally, usqaltam ba’avanim {וּסְקַלְתָּם בָּאֲבָנִים | ū-sə-ḳal-tam bā-ʾă-vā-nîm} ‘and you shall stone them with stones’ and vametu {וָמֵתוּ | wā-mê-tû} ‘and they shall die’ present the outcome in paratactic sequence, rendered in English with parallel structure to retain legal clarity.
